Welcome to Ventures Away. This document sets out the terms and conditions that govern the use of our platform. Please read carefully before registering or using our services.

1. Definitions and Scope
1.1. Definitions
• Platform: Includes the Ventures Away website, mobile application, and associated services.
• User: A natural or legal person who uses the platform as a host or guest.
• Host: A user who publishes properties for rent on the platform.
• Guest: A user who books properties through the platform.
• Property: Any housing unit listed for rent.
• Damages: Physical, financial, or legal losses suffered by a user or property.
• Payment Provider: Third-party entity that manages payments processed on the platform.
1.2. Scope of the Terms
These terms apply to all users of the platform. By registering or using Ventures Away, you agree to abide by these terms.

2. Account Creation and Use of the Platform
2.1. Requirements for Creating an Account
• Users must be over 18 years of age.
• It is mandatory to provide accurate and up-to-date information.
• Each account is personal and non-transferable.
2.2. User Responsibilities
Users must:
• Use the platform in accordance with all applicable local and international laws.
• Refrain from fraudulent, illegal or activities that may damage the reputation of Ventures Away.
2.3. Suspension and Termination of Accounts
• Ventures Away reserves the right to suspend or delete accounts in the event of non-compliance, fraud or inappropriate behavior.
• Users will be notified in advance, except in serious cases.

3. Host Obligations
3.1. Legal Compliance
• Hosts must ensure that their properties comply with local laws, including permit, zoning, licensing, and tax requirements.
• In Puerto Rico, hosts are responsible for registering their properties in accordance with local regulations, such as lodging tax.
3.2. Property Conditions
• Properties must be safe, clean, and habitable at all times.
• The host is responsible for inspecting and ensuring that the facilities are in proper working order (water, electricity, WiFi, among others).
3.3. Cancellation Policies
• Each host must establish a clear cancellation policy, which will be binding on guests.
3.4. Insurance and Liability
• It is the host's responsibility to acquire adequate insurance to cover damage or accidents on the property.
• Ventures Away assumes no liability for damage or incidents related to the properties.

4. Guest Obligations
4.1. Reservations
• Guests should carefully read property descriptions and make sure they understand the rules set by the host before booking.
4.2. Behavior During the Stay
• Guests must abide by the house rules, keep the property in good condition, and avoid illegal activities.
• In the event of damage caused by the guest, the guest will be responsible for repair or replacement costs.
4.3. Cancellations
• Cancellations are subject to the host's policies.
• Ventures Away service fees are non-refundable.

5. Payments, Fees, and Refunds
5.1. Payment Processing
• Payments are processed through a third-party vendor and are subject to their terms and conditions.
• Guests authorize Ventures Away to retain and distribute funds corresponding to hosts and service fees.
5.2. Taxes
• Ventures Away may collect taxes on behalf of local authorities as required by applicable laws.
• Hosts are responsible for reporting and paying taxes on income earned through the platform.

6. Dispute Resolution Policies
6.1. Between Users
• Ventures Away will act as a mediator if both parties request it.
• The platform does not guarantee favorable resolutions and will not be responsible for unresolved conflicts.
6.2. With Ventures Away
• Any dispute between a user and Ventures Away will be resolved through binding arbitration in Puerto Rico.

7. Limitation of Liability
7.1. Ventures Away Disclaimer of Liability
• Ventures Away is not responsible for:
o Damages or losses suffered by hosts or guests.
o The quality, safety, or legality of the listed properties.
o Inappropriate or illegal conduct by users.
7.2. Damage to Property
• Hosts and guests agree to resolve any damage caused to the property during a stay between themselves.
• Ventures Away assumes no responsibility for inspecting or guaranteeing the condition of the properties.

8. Security and Data Protection
8.1. Privacy
• Users' personal information is handled in accordance with Ventures Away's Privacy Policy.
• Sensitive data will be protected through encryption systems.
8.2. Security in Transactions
• All transactions on the platform are processed securely by our payment provider.

9. Emergencies and Natural Disasters
• In cases of emergencies such as hurricanes, earthquakes or other disasters, Ventures Away will work with hosts and guests to facilitate reasonable solutions.
• Refund policies in these situations will be subject to the specific circumstances and local laws.

10. Modifications and Notifications
• Ventures Away may modify these terms with 30 days' notice.
• Updates will be communicated by email and posted on the platform.
